Terms of Service

1. Acceptance of Terms

By accessing or using FixMyCWV (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Service Operator

The Service is operated by Oleksandr Utkin, OSVČ (IČO: 24392596), Vrbenského 1640/43, 170 00, Praha 7 – Holešovice, Czech Republic.

3. Description of Service

FixMyCWV is a web-based tool that analyzes Core Web Vitals performance metrics for URLs you provide. The Service uses a stealth browser with residential proxies to collect real performance data, and AI (Claude by Anthropic) to generate technical recommendations.

4. User Responsibilities

You agree to:

• Provide accurate information when creating your account
• Only audit URLs you have authorization to analyze
• Not use the Service to disrupt or overload target websites
• Not resell or redistribute audit reports without a paid plan

5. Payments and Refunds

Payments are processed securely through Stripe. Monthly subscriptions (Pro, Agency) can be cancelled at any time — you retain access until the end of your billing period. No partial refunds are given for unused portions of a billing cycle.

6. Right of Withdrawal (EU Consumers)

Under the EU Consumer Rights Directive, you have 14 days from the date of purchase to withdraw without giving a reason. However, by initiating an audit, you expressly consent to the immediate performance of the Service and acknowledge that you lose your right of withdrawal once the audit report has been generated. For one-time purchases where the audit has not yet started, contact a.utkin17@gmail.com within 14 days for a full refund.

7. Intellectual Property

The audit reports generated for you are yours to use. The FixMyCWV service, including its AI models, knowledge base, analysis methodology, and user interface, remains the intellectual property of the operator.

8. Limitation of Liability

FixMyCWV provides recommendations on a best-effort basis. We do not guarantee specific performance improvements. The Service is provided "as is" without warranties of any kind. We are not liable for any damages resulting from the use of our recommendations or inability to access the Service.

9. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications to the Service at any time. We reserve the right to suspend or terminate accounts that violate these terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic.

11. Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email.
